Terms of Sales

Acceptance of these general conditions of sale:

These conditions apply to the sale of wines from the EARL DOMAINE CHRISTIAN GAUTHIER, accessible via the Internet, by telephone, by email or by post. They are automatically made available to the buyer if he so requests. Consequently, the fact of placing an order implies the buyer’s full and unreserved acceptance of these “General Conditions of Sale”, to the exclusion of all other documents such as prospectuses, press, catalogs or e-mailings, issued by the seller and which have only an indicative value. The fact that the seller does not avail himself at a given moment of any of the provisions hereof cannot be interpreted as a waiver to avail himself later of one of the said conditions.
These general conditions of sale are law between the parties, and apply in full, except for express derogation stipulated on the order form.

Protection of minors:

In accordance with the Public Health Code, the purchase of alcoholic beverages being prohibited for minors, the buyer agrees to be of the legal age required on the date of his order.

Alcohol abuse:

Alcohol abuse is dangerous for health. Know how to consume and enjoy in moderation.

Orders and prices:

Orders can be placed by phone, email, messaging or on the website. Domaine Christian Gauthier undertakes to honor orders received within the limits of its available stocks. In the absence of availability of a product, the buyer will be informed as soon as possible.
For all the wines, the prices are indicated in Euros (€) including VAT (amount of VAT 20%), ex-cellar, excluding shipping costs.

Shipping costs:

Shipping costs vary according to the type of transport, the place of delivery and the quantities ordered. They are valid exclusively in metropolitan France (excluding Corsica).

Delivery method and time:

Delivery within the agreed time can only take place if the customer has communicated to the seller exact information on the recipient’s contact details (surname, first name, address, postal code, city, country, door codes, landline and mobile telephone number, etc.).
Delivery is made by the producer himself, or by carrier, to the address indicated by the customer at the time of his order (or by notice of availability in the absence of the customer). Exceeding delivery times cannot give rise to damages, deductions or cancellation of orders in progress. In any case, delivery on time can only occur if the customer has communicated to the seller exact information on the recipient’s contact details. In the event of an error, Domaine Christian Gauthier cannot be held responsible for the impossibility of delivering the goods to the desired place and time. The goods always travel at the recipient’s risk and peril. Upon receipt of the goods, it is the recipient’s responsibility to check the condition of the goods upon receipt and to make any necessary observations in the event of breakage, damage or missing items, by expressing their reservations on the delivery note, and in the 48 hours following receipt of the goods, by registered letter with acknowledgment of receipt from the seller or the carrier, including a copy to the seller, in order to preserve his rights.

Payment:

Payment for goods is made: when ordering by credit card on the website, or in cash when picking up at the cellar. No discount is granted for early payment.
Any sum not paid on the due date shall give rise to the application of right and without formal notice of late payment interest at the legal interest rate increased by 10%. In the event of recovery by way of litigation, this will give rise to a fixed indemnity of €40, without prejudice to late payment interest and damages.

Retention of title:

The transfer of ownership of the goods is subject to full payment of the price on the agreed date. However, the risks will be transferred upon removal. In the event of non-payment on the due date, the EARL Domaine Christian Gauthier will take possession of the goods of which it remains the owner without any prior formality. Under no circumstances may the buyer give the goods not yet fully paid for, as a pledge, or transfer ownership of them as guarantee.

Applicable law and competent jurisdiction:

These T&Cs are subject to the application of French law. The courts of the seller’s head office will have sole jurisdiction for any dispute arising from the application of these conditions.
